Not in one of these states?

Many insurance carriers file their own 5% drug-free workplace credits in states without a specific statute — credits have been approved in CT, IL, IN, MD, MA, MI, NY, NC, OR, PA, UT, and others. Ask your broker, and APCA can provide the program documentation your carrier requires.

Note: Washington State discontinued its drug-free workplace credit program in 2001. Some websites still list it — it is no longer active.

Positive post-accident tests can support denial or reduction of comp claims under state intoxication defense statutes. Several DFWP laws create a rebuttable presumption the injury was drug-caused.

How to claim your credit

There are three certification models depending on your state. APCA prepares your documentation and guides you through whichever path applies.

In these states you certify directly with a state agency, then hand the certificate to your insurance carrier annually.

Georgia

Apply online at sbwcdfwp.org (checklist application, $35 fee). Certificate valid 1 year. Submit a copy to your carrier each year for the 7.5% credit — the highest rate in the nation.

Tennessee

Mail the application to the Dept. of Labor & Workforce Development with proof of coverage, your substance-abuse policy, and EAP info. Renew annually. DOT-regulated employers are entitled to the credit.

Alabama

File the certification application with the Dept. of Labor WC Division. Keep compliance records available for review.

Mississippi

Certify under MWCC rules. Show proof of certification to your insurer annually.
